US Cannabis: 18 Recreational States, 37 Medical States | Feb 2022

The current state laws for each state that has regulated recreational marijuana.

Cannabis in the US is moving towards more legalization year after year across each state. While still federally classified as a Schedule I substance, each state has adopted their own ruling on the use of regulated cannabis. California was the first state to legalize medical cannabis in 1996, sparking a trend that spread to the majority of the states by 2016. In 2012, Washington and Colorado became the first states to legalize recreational cannabis. Currently there are a total of 18 states that have legalized recreational cannabis, and 37 states that have legalized medical cannabis.

Which States Is Cannabis Legal In For Recreational Use?

Colorado: Legalized in 2012.  Adults 21 and over may possess up to 1 ounce of cannabis, and 8 grams of concentrates. Adults of legal age may also grow up to 6 plants at home.

Washington: Legalized in 2012. Adults 21 and over may purchase up to 1 ounce of flower, 16 ounces of infused edibles, 72 ounces of infused liquids, and 7 grams of concentrates.

Alaska: Legalized in 2014. Alaska residents 21 and over may up to 1 ounce of cannabis, or 4 ounces in a private residence. Alaska allows adults of legal age to grow up to 6 plants, with up to 3 of the plants flowering.

Oregon: Legalized in 2014. Adults 21 and over may possess up to 1 ounce of cannabis, or up to 8 ounces in a private residence. Adults of legal age may also possess up to 1 ounce of concentrates, 16 ounces of infused edibles, 72 ounces of infused liquids, 10 marjuana seeds, and 4 marijuana plants.

California: Legalized in 2016.  Adults 21 and over may possess up to 1 ounce of cannabis, and 8 grams of concentrates. Adults of legal age may also grow up to 6 plants at home.

Maine: Legalized in 2016. Adults 21 and over may possess up to 2.5 ounces of cannabis, which may include up to 5 grams of concentrates. Adults of legal age may also grow up to 12 plants, with up to 6 of the plants flowering.

Massachusetts: Legalized in 2016. Adults 21 and over may possess up to 1 ounce of cannabis, and 5 grams of concentrate. Adults of legal age may have up to 10 ounces at a home, but anything over 1 ounce must be locked up.

Nevada: Legalized in 2016. Adults 21 and over may possess up to 1 ounce of cannabis, and up to ⅛ of an ounce of concentrates. Adults of legal age may grow up to 6 plants per person, and 12 plants per household.

Vermont: Legalized in 2018. Vermont was the first state to legalize through its Legislature instead of through a ballot measure. Adults 21 and over may possess up to 1 ounce of cannabis, 2 mature plants, and 4 immature plants. Recreational retail sales are expected to start no sooner than October 2022.

Michigan: Legalized in 2018. Adults 21 and over may possess up to 2.5 ounces of cannabis, which may include up to 15 grams of concentrates. Adults of legal age may have up to 10 ounces at home; and can grow up to 12 plants, as long as they are hidden from the public.

Illinois: Legalized in 2019.Illinois legalized cannabis through its Legislature instead of a ballot measure. Adults 21 and over may possess up to 30 grams of cannabis, and up to 5 grams of concentrates.

New Jersey: Legalized in 2020. Adults 21 and over may possess up to 1 ounce of cannabis. Home cultivation is not allowed.

Montana: Legalized in 2020. Adults 21 and over may possess up to 1 ounce of cannabis, or the THC equivalent in other forms: 800 milligrams of edibles or 8 grams of concentrates.

Arizona: Legalized in 2020. Adults 21 and over may possess up to 1 ounce of cannabis, which may include up to 5 grams of concentrates.

New York: Legalized in 2021. Adults 21 and over may possess up to 3 ounces of cannabis, or 24 grams of concentrates.

Virginia: Legalized in 2021.  Adults 21 and over may possess up to 1 ounce of cannabis, and grow up to 4 plants. Retail recreational sales is set to begin in 2024.

New Mexico: Legalized in 2021. Adults 21 and over may possess up to 2 ounces of cannabis, or up to 16 grams of concentrates, or up to 800 milligrams of edibles. Adults of legal age may also grow up to 6 plants per adult  at a private residence; or up to 12 plants per household.

Connecticut: Legalized in 2021. Adults 21 and over may possess up to 1.5 ounces of cannabis, and another 5 ounces in a secured container at home.
